Paradise Links Resort – Port Douglas, Queensland
These Terms & Conditions apply to all accommodation within Paradise Links Resort, including villas, apartments, and hotel rooms (“Property”).
By making a booking or occupying any Property within the Resort, the Guest agrees to these Terms.
1. Booking & Payment
1.1 A booking is not confirmed until payment (deposit or full amount) is received.
1.2 The balance must be paid by the due date advised at booking.
1.3 Failure to pay may result in cancellation without notice.
2. Cancellation Policy
2.1 All cancellations must be made in writing.
2.2 Cancellations made within fourteen (14) days of the scheduled arrival date are non-refundable.
2.3 No-shows, failure to arrive, or early departures are non-refundable.
2.4 Date changes requested within fourteen (14) days of arrival are treated as cancellations and the above policy applies.
2.6 Any refund approved outside these terms is granted solely at the discretion of Management.
2.7 Nothing in this policy excludes, restricts or modifies rights under the Australian Consumer Law.
3. Security Bond / Pre-Authorisation
3.1 A security bond or credit card pre-authorisation may be required.
3.2 The Resort may deduct costs for:
- Damage to property or common areas
- Missing items
- Excess cleaning
- Smoking in non-smoking areas
- Security call-outs
- Breaches of by-laws or resort rules
4. Occupancy Limits
4.1 Maximum occupancy per lot must not be exceeded.
4.2 Additional guests are not permitted without written approval.
4.3 Parties, events, schoolies groups, and large gatherings are strictly prohibited.
5. Behaviour & Noise
5.1 Quiet hours apply between 10:00pm and 7:00am.
5.2 Excessive noise at any time is prohibited.
5.3 Anti-social behaviour will result in eviction without refund.
5.4 The Resort reserves the right to involve security or police if required.
6. Compliance with Body Corporate By-Laws
6.1 Paradise Links Resort operates within a community titles scheme.
6.2 Guests must comply with:
- All Body Corporate by-laws
- Resort rules
- Directions from management
6.3 Breaches may result in:
- Fines (if applicable)
- Immediate termination
- Charges to the Guest
7. Common Property
7.1 Guests may use common facilities only in accordance with posted rules.
7.2 Children must be supervised at all times, including pool areas.
7.3 No glass in pool areas.
7.4 The Resort is not liable for temporary closure of facilities.
8. Damage & Cleaning
8.1 Guests are responsible for leaving the Property in reasonable condition.
8.2 Additional cleaning charges may apply if excessive cleaning is required.
8.3 Damage beyond fair wear and tear will be charged.
9. Liability
To the extent permitted by law:
9.1 The Resort, letting agent, Body Corporate, and individual lot owners are not liable for:
- Loss or theft of personal items
- Injury arising from misuse of facilities
- Events beyond reasonable control
This clause operates subject to the Competition and Consumer Act 2010.
10. Termination of Stay
Management may terminate occupancy immediately if:
- Terms are breached
- Occupancy limits are exceeded
- Property is used unlawfully
- Guests refuse reasonable directions
No refund will be payable.
11. Force Majeure
The Resort is not liable for circumstances beyond its control, including natural disasters, government directives, or utility failures.
12. Privacy
Personal information is handled in accordance with Australian privacy legislation.
